"Unrelenting demands for energy, infrastructure and natural resources, the need for developing states to augment tax reserves and signal an enterprise ready attitude, mean that transnational development projects remain a go to tool for economic development. Yet little is known about the fragmented legal framework of private financial mechanisms, contractual clauses and discretionary behaviours that shape modern development projects. How do gaps and biases in formal laws cope with the might of concessionaires and financiers and their algorithmic contractual and policy technicalities negotiated in private offices? What impacts do private legal devices have for the visibility and implementation of indigenous peoples’ rights to land? Robert Nichols develops the concept of ""recursive dispossession"" to describe the critical bind that indigenous activists face when seeking justice for the appropriation of their land: they simultaneously claim that their land was stolen by Anglo settlers, but also that territoriality and property ownership are themselves settler concepts. Putting indigenous thought into conversation with Marxist theory, Nichols argues that property relations under settler colonialism are built upon a structural form of negation, wherein some groups must be alienated from the very property that is being created. Thus, theft precedes and generates property, rather than vice versa, and indigenous claims of retroactive ""original ownership"" are not contradictory or logically flawed, but rather, gesture back to this very dynamic. "The dispossession of indigenous peoples by conquest regimes remains a pressing issue. This book, unlike most other books on the subject, contrasts two different colonial administrations – first the Chinese Qing Empire, then, from 1895, the Japanese. It shows how , under the Chinese legal system, the Qing employed the Chinese legal system to managed the relationship between the increasing numbers of Han Chinese settlers and the indigenous peoples, and how, although the Qing regime took no and refrained from taking actions to transform aboriginal land tenure, and how nevertheless Chinese settlers were able to manipulate aboriginal land tenure to their advantage. It goes on to examine the very different approach of the Japanese colonial administration, which following the Meiji Restoration of 1868 had begun to adopt a Western legal framework, demonstrating how this was intentionally much more intrusive, and how the Japanese modernized legal framework significantly disrupted aboriginal land tenure. "The right of indigenous peoples to Free Prior and Informed Consent (FPIC) in relation to natural resource extraction in their territories is a principle that is increasingly recognised by intergovernmental organizations, international bodies, conventions and international human rights law as well as in the domestic law of some States. This book offers a comprehensive overview of the status of Free Prior and Informed Consent under international human rights law, considering the main controversies, obstacles and challenges associated with its recognition and implementation. The historical basis for FPIC is considered as well as the legitimacy of the dominant doctrines of exclusive State ownership of subsoil resources. A vast number of national parks and protected areas throughout the world have been established in the customary territories of Indigenous peoples. In many cases these conservation areas have displaced Indigenous peoples, undermining their cultures, livelihoods, and self-governance, while squandering opportunities to benefit from their knowledge, values, and practices.
